Zibt Terms and Conditions

Welcome to Zibt! By downloading, accessing, or using the Zibt app ("App"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the App. These Terms constitute a legally binding agreement between you ("User") and Zibt ("Company," "we," "our," or "us").

1. Use of the App

1.1 Eligibility

To use the App, you must:

• Be at least 13 years old.
• Have the legal capacity to enter into this agreement.
• Agree to comply with these Terms and all applicable laws.

1.2 License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes. Any unauthorized use of the App is strictly prohibited.

1.3 Restrictions

You agree not to:

• Modify, distribute, or reproduce the App.
• Use the App for unlawful purposes.
• Interfere with the operation of the App or attempt to hack or circumvent security features.
• Use the App in a manner that violates intellectual property rights or applicable laws.

2. Account Creation and Security

2.2 Account Responsibility

You are responsible for all activities under your account. Notify us immediately if you suspect unauthorized access or a security breach.

We reserve the right to suspend or terminate your account at any time, without notice, for any reason, including but not limited to violation of these Terms.

3. User Content

3.1 Content Ownership

You retain ownership of any content you upload or create within the App ("User Content"). However, by submitting User Content, you grant us a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and modify the content for the purpose of operating and improving the App.

3.2 Prohibited Content

You agree not to upload content that:

• Violates applicable laws or regulations.
• Infringes upon intellectual property rights.
• Contains harmful, obscene, or offensive material.
• Promotes illegal activities or harassment.

We reserve the right to remove any User Content that violates these Terms.

4. Advertising and Partnerships

4.1 Advertising Revenue

Zibt is free for all users. We generate revenue through advertisements displayed in the App and partnerships with brands that may include priority advertising placements.

4.2 User Interaction with Ads

By using the App, you agree that:

• Advertisements may be shown to you based on your usage patterns and preferences.
• Zibt is not responsible for the content or accuracy of third-party advertisements.
• Interacting with advertisements or clicking on external links is at your own discretion and risk.

4.3 Sponsored Content

From time to time, you may see sponsored content or promotional materials from our partners. These will be clearly labeled as advertisements or sponsored content.

5. Intellectual Property

5.1 Ownership

All content and features of the App, including but not limited to text, graphics, logos, and software, are the property of Zibt or its licensors and are protected by intellectual property laws.

5.2 Trademarks

"Zibt" and associated logos are trademarks of Zibt. Unauthorized use of these trademarks is strictly prohibited.

6. Cookies and Tracking

6.1 Use of Cookies

Zibt uses cookies and similar technologies to enhance your experience. Cookies help us personalize your experience, improve the App's functionality, and deliver relevant advertisements. By using the App, you consent to our use of cookies as outlined in the Privacy Policy.

6.2 Managing Cookies

You can manage or disable cookies through your device settings. However, disabling cookies may limit the functionality of some features in the App.

7. Third-Party Services

The App may include links or integrations with third-party services. We are not responsible for the content, policies, or practices of third-party services. Your use of third-party services is subject to their respective terms.

8. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be error-free or uninterrupted.

9. Limitation of Liability

To the maximum extent permitted by law, Zibt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of the App.

Additionally, Zibt is not liable for any car accidents, delays, missed commitments, or other events that may occur as a result of using the App, including but not limited to alarm settings or route recommendations. By using the App, you assume full responsibility for your actions and outcomes once the alarm is set off or the commute recommendations are provided.

Our total liability for any claims related to the App shall not exceed the amount you paid, if any, to use the App.

10. Indemnification

You agree to indemnify and hold Zibt harmless from any claims, liabilities, damages, losses, or expenses arising from:

• Your use of the App.
• Your violation of these Terms.
• Your infringement of any third-party rights.

11. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to the App or other users.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina. Any disputes arising under these Terms shall be resolved exclusively in the courts of North Carolina.

13. Changes to These Terms

We may update these Terms from time to time. Any changes will be effective upon posting in the App. Your continued use of the App constitutes acceptance of the updated Terms.
